Contest Rules

Now that you’re excited about starting to plan and build your app, here are some ground rules for playing the game. If you don't follow the rules, you're out. And trust us, we'll know. The short of it:
  1. You and your team members must be enrolled part time or full time at a Canadian high school or post-secondary school.
  2. You can work individually or as part of a team up to a maximum of four members.
  3. Your team can be made up of students from different schools.
  4. You cannot submit an entry that is, or will be, part of another contest at the same time.
  5. Your app will be judged based on the following criteria.
  6. The contest will accept submissions until Friday, January 29, 2015 at 5:00 pm EST.
  7. All apps must be developed for the Andrdoid platform.
  8. By registering for the contest, you agree that you, and your team, have read and complied with all the rules.
  9. This contest is not available to students in Quebec.
The legal version By submitting an entry to the William Osler Health System (Osler) Kiss My App Contest, you are automatically agreeing to be bound by the following legal terms outlined in the Official Rules. SPONSOR The Osler Kiss My App Contest (the “Contest”) operated by Osler, 2100 Bovaird Drive East, Brampton, Ontario, L6R 3J7. CONTEST OBJECTIVE The objective of the Contest is to challenge students to develop a creative and innovative solution in the pursuit of enhancing the patient experience at Osler. This Contest is not a game of chance, lottery or draw and does not require an entry fee. ELIGIBILITY The Contest is open to all full-time or part time students enrolled in a Canadian high school or post-secondary institution in any program or discipline except employees, representatives or agents of William Osler Health System or William Osler Health System Foundation. The Contest is closed to students in Quebec. All Entries (as defined below) and Eligible Entrants are subject to verification in the sole and absolute discretion of the Sponsors. The Sponsors reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsors – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsors in a timely manner may result in disqualification. ENTRIES, TEAMS, ENTRANTS Entries

An entry consists of the materials submitted in the method and format specified at the time of the contest.

All entries must be submitted in English, Video submissions must be in .avi, .wmv, .mov or .mp4 format.  The prototype round must be submitted in .apk format, or other formats compatible with Android software development platforms, within the given time period specified in the Official Rules and adhere to the guidelines outlined on the Website.

Teams Multiple students may collaborate from the same school or a different school to form a team, or you may choose to participate individually. Participants may only be part of one team. A single entry must be submitted on behalf of a team and each team can not submit more than one entry. Teams are responsible for deciding how the prize money is allocated. Entrants Each individual or team who submits an entry is referred to as an “entrant.” Each entrant will be responsible for all equipment and costs they incur as part of their participation in the competition. Osler is not responsible for late, lost, stolen, damaged, incomplete, incorrect entries, any errors, interruptions, deletions, delays, defects related to technical or other failures of computer hardware, software, communication devices, any data corruption, theft or destruction of entry material. Osler is not responsible for damage to any computer due to participation in the Contest or due to accessing or downloading information related to the Contest. CONTEST DATES The contest will be open for video pitch submissions until Friday, January 29 at 5:00pm EST. Judging will occur in rounds.  In round One, app concept videos will be posted online for public access to vote.  Voting will be capped at one vote per IP address.  In round Two, app design videos will be posted online for staff voting.  The creators of the five videos with the most votes will be contacted to submit a prototype of the app within two weeks' time.  In this final round, the app prototype will be evaluated by a panel of judges, based on the criteria outlined in the Judging Criteria section and compliance with the guidelines outlined in the Official Rules. The winner of the Contest will be announced following the judging. HOW TO ENTER Individuals may submit their video pitch for the app outlining the app concept and design until January 29, 2016 at 5:00pm  EST. By submitting a video, the individual or team is considered an entrant of the Contest. Each individual and each team cannot submit more than one entry. Entrants are highly encouraged to consult the Kiss My App Contest website on a regular basis for further updates and revisions. BY SUBMITTING AN ENTRY FOR THE KISS MY APP CONTEST, YOU AUTOMATICALLY ACCEPT THE TERMS, CONDITIONS, GUIDELINES AND RULES OUTLINED IN THE OFFICIAL RULES, AGREE TO BE BOUND BY THE DECISIONS OF THE JUDGES AND AFFIRM THAT YOU ARE ELIGIBLE TO PARTICIPATE IN THE CONTEST. SUBMISSION GUIDELINES Entrants will have four themes at the start of the contest. Entrants must design the best possible app with a gaming slant that will positively impact the overall patient experience in line with the theme. The app must be developed and designed for an Android platform. Use the hospital information and background to understand the diverse community that Osler, Central West CCAC and Headwaters Health Care Centre serves. Consider the health care organizations' goals and strategic direction and to incorporate features that the patients will find valuable. Finally, consider the impact of your solution on the broader system of patients and families. Interpret the theme given at the start of the Contest to guide your decision-making. JUDGING Judging will occur in three rounds. Week One: The Concept
  • The concept portion of the video will be posted online for public voting for one week.
Week Two: The Design
  • The design portion of the video will also be included for staff voting for one week
The five videos with the most votes will be contacted and given a two-week period to build a prototype of their app in .apk format to submit to Osler for a final round of judging that will take place at a later date. All teams will be notified by email or phone within a month of the contest about the outcome of their submission. Each section outlined below will be allotted a score of one to three (1 to 3) (poor, average, excellent). The final scores for the entrants will be the average of the steering committee’s decision.  The apps will be judged on the following criteria:
  • Impact on the Central West region, including Osler, Headwaters, and the CWCCAC: Will the app be relevant for all three health care organizations? Does one hospital benefit more than the other?
  • Innovation of the app: Is the idea creative and original? Does it have unique elements and features?
  • Art, design and polish of the app: Is the app graphically appealing? Does it draw users in? Are transitions smooth?
  • User interface: Is the app easy to use and understand? Does it flow? Is it bloated with extraneous elements that don’t add value?
  • Entertainment value: Is the app fun to use? Does it provide enough draw to keep users coming back?
  • Longevity of the app: Is the app easy to update? Will it fall out of date within a year?
  • App stability: Is the app stable? Does it run smoothly without crashing? Are there any errors?
In the event of a tie, the tie will be broken in the following manner:
  • The entrant with a higher score in Impact on Central West Region will be the winner of the tie breaker
  • If the entrants have the same score in Impact on Central West Region, the entrant with a higher score in Innovation of the App will be the winner of the tie breaker
  • If the entrants have the same score in Innovation of the App, the entrant with a higher score in Art, Design and Polish will be the winner of the tie breaker
  • If the entrants have the same score in Art, Design and Polish, the entrant with a higher score in User Interface will be the winner of the tie breaker
  • If the entrants have the same score in User Interface, the entrant with a higher score in Entertainment Value will be the winner of the tie breaker
  • If the entrants have the same score in Entertainment Value, the entrant with a higher score in Longevity of App will be the winner of the tie breaker
  • If the entrants have the same score in Longevity of App, the entrant with a higher score in App Stability will be the winner of the tie breaker
AWARDS/PRIZES Osler is under no legal obligation to award the prize to any entrant. The grand prize of ten thousand dollars ($10,000.00) will be awarded to the winner, if any, (the individual or the team) of the Contest based on the judging criteria and compliance with the guidelines outlined in this document. Upon determination of a winner, the winner will be notified by Osler. After verification of eligibility, the winner will receive the prize in the form of a cheque made out to the prize winner. Awards will be distributed to one individual entrant from each team. Team members are responsible for allocating prize money. The prize winner(s) will also be required to complete, sign and return a receipt indicating they have received the prize. Potential winners will be disqualified and the prize may be awarded to an alternate winner if (a) the required documentation is not signed and returned within five (5) business days after receipt, (b) the prize notification letter or email, or the prize itself is returned as undeliverable, (c) the potential winner or winning team member is disqualified for any reason. By accepting the prize, the winner(s) agrees to the use of his/her name and/or prize information by Osler for promotional purposes in any medium without additional compensation or notification. By accepting the prize, the winner(s) agrees to work with mentors in the hospital to develop the app to completion. This is a contest of skill. Whether or not your entry is selected as a winner depends on how your entry compares to the other entries submitted in the Contest when evaluated based on the judging criteria. No substitution or transfer of prize is permitted. GENERAL INTELLECTUAL PROPERTY AND PERSONAL INFORMATION RIGHTS Osler makes no claim to ownership of your entry or any intellectual property that it may contain, except as specified herein. By submitting an entry, each individual entrant and each individual member of a team gives Osler the right to review your entry and have the steering committee and judges panel review your entry as well. You also grant Osler the right to post information about your entry, as determined by Osler, including but not limited to your name or the name of all members in a team, in connection with the Contest, in any media or format and in any location without any payment or further consent from you or from each member of a team. You agree that this consent cannot be revoked. For uses beyond the consent that you grant above, you agree that Osler’s use of your personal data will be governed by the Privacy Policy posted on the Osler website. You agree that nothing in the Official Rules grants you a right or license to use Osler’s name or any Osler trademark or service mark. You grant Osler the right to include your name or the names of all members in a team and the team name on the Contest Website and in materials related to recognition of the Contest winner. Nothing in this Contest requires you to negotiate or do business with Osler, except as specified herein with regards to claiming of the prize money. You are free to discuss your entry and the ideas or technologies that it contains with other parties and you are free to contract with any third parties as long as you do not sign any agreement or undertake obligations that conflict with any agreement that you have entered into or do enter into with Osler regarding your entry. You acknowledge that the purpose of the Contest is to encourage people to suggest their ideas and innovations to Osler. Participating in the Contest does not create an obligation on either your part or Osler’s part to enter into any further business relationship or to sign any commercial agreement. By participating in the Contest, each participant agrees to be legally bound by these Rules and by the interpretation of these Rules by the Sponsors, and further warrants and represents that his/her Application:
  • is original to him/her (or, in the case of a Team, to at least one of the Team members) and that the Eligible Entrant has (or has obtained) all necessary rights in and to the Application (and all components thereof) to enter the Contest;
  • is not, and will not be submitted in another Contest of similar nature for the duration of the Contest;
  • does not violate any law, statute, ordinance or regulation;
  • does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence (note: if consent cannot be obtained for an individual appearing in the Application, then his/her face must be blurred out and voice (if applicable) must be altered so as to be unrecognizable);
  • will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, including, without limitation, intellectual property rights or give rise to any claims for payment whatsoever; and.
  • is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual or religious groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services; any identifiable third party products, trade-marks, brands and/or logos (note: if the necessary consents cannot be obtained, then all identifiable third party products, trade-marks, brands and/or logos must be blurred out so as to be unrecognizable); conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsors in their sole and absolute discretion.
CONFIDENTIALITY AGREEMENT Osler does not wish to receive or hold any submitted materials in confidence therefore, it is agreed that, with respect to your entry, no confidential relationship or obligation of secrecy is established between Osler and you or Osler and the team, if you are part of a team. If your entry is selected as a winner, Osler may offer to sign a confidentiality agreement as part of further discussions of your entry and the technology. LICENSE/OWNERSHIP OF THE APP In consideration for the prize, the winner or if the winner is a team, each individual member on the winning team, agrees that Osler will become the sole owners of the app and all associated intellectual property and agrees to provide Osler with the complete code of the app for use at Osler’s discretion without further compensation, monetary or otherwise. INDEMNITY AND EXCLUSION OF LIABILITY By participating in the Contest, each entrant agrees to indemnify and hold harmless Osler, each of the judges and each of their respective representatives, directors, officers, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any sort resulting from your participation in or association with the Contest. Without limiting the foregoing, Osler is not responsible for any miscommunications such as connections, technical failures or other failures related to hardware, software or virus, or late, misdirected, incomplete entries. Osler reserves the right to cancel, modify or suspend the Contest at its absolute discretion. Osler will not have liability or responsibility for the use of any aspect of your entry, by any other individual or entity. NO OBLIGATION You acknowledge that many participants may submit entries that contain concepts or technologies similar to your entry. You acknowledge and agree that Osler’s action with respect to another entry, even if similar to your entry, shall not create for Osler any liability to you or others. Osler is not and shall not be restricted from pursuing, developing, or commercializing in any manner, independent of you and at Osler’s sole discretion, any technology that is created independent of your entry. You acknowledge that Osler is not obligated to take any action with regard to your entry. LAW You agree that these terms and the relationship between you and Osler shall be governed by the laws of the province of Ontario and the laws of Canada applicable therein.
